TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern access to and use of the BusTrail Solutions mobile applications and web portals.

1. OPERATOR INFORMATION

BusTrail Solutions is operated by:

BusTrail Solutions is a product line of Jaylan Solutions Limited.

2. SCOPE OF APPLICATION

These Terms apply to all users of:

  • BusTrail Guardian App

  • BusTrail Driver App

  • School Administration Portal (school.bustrail.co.ke)

  • Any related services provided under the BusTrail platform

By accessing or using the Platform, you agree to be bound by these Terms.

3. USER CATEGORIES

Users of BusTrail Solutions include:

  • Schools and school administrators

  • Parents and guardians

  • Drivers and transport personnel

  • Authorized system administrators

Each user may only access features assigned to their role.

4. SERVICE DESCRIPTION

BusTrail Solutions is a school transportation management system providing:

  • Student pickup and drop-off tracking

  • Real-time GPS bus location

  • Notifications and alerts

  • Driver, vehicle, and route management

  • QR-code based student check-in/check-out

  • Reporting and analytics

The Platform is provided on a Software-as-a-Service (SaaS) basis.

5. ACCOUNT REGISTRATION & ACCESS

  1. Users must provide accurate and complete information during registration.

  2. Some users (drivers, students) require school or administrator approval.

  3. Users are responsible for safeguarding their login credentials.

  4. Jaylan Solutions may suspend or terminate accounts for security or compliance reasons.

6. ACCEPTABLE USE

Users agree to:

  • Use the Platform only for lawful school transport purposes

  • Respect privacy and child protection obligations

  • Comply with the Acceptable Use Policy (AUP)

  • Not misuse tracking, messaging, or data access features

Any misuse may result in account suspension or termination.

7. CHILD DATA & PARENTAL CONSENT

  1. BusTrail Solutions processes children’s personal and location data, which is classified as high-risk data.

  2. Schools are responsible for obtaining parent/guardian consent.

  3. Parents may view only data related to their own children.

  4. Location tracking occurs only during active transport trips.

8. DATA PROTECTION & PRIVACY

  1. Data is processed in accordance with:

    • The Data Protection Act, 2019 (Kenya)

    • BusTrail Privacy Policy

    • Data Processing Agreement (DPA)

  2. Jaylan Solutions implements security measures including encryption, access controls, and monitoring.

  3. Users have rights to access, correction, and lawful deletion of data.

9. SYSTEM AVAILABILITY

  1. Jaylan Solutions aims to provide high system availability, subject to maintenance and external dependencies.

  2. Scheduled maintenance may occur with reasonable notice.

  3. Service availability is governed by the Service Level Agreement (SLA) where applicable.

10. INTELLECTUAL PROPERTY

  1. The BusTrail platform, software, branding, and documentation are protected by intellectual property laws.

  2. Users are granted a limited, non-exclusive, non-transferable license to use the Platform during active service.

  3. Users may not copy, modify, reverse engineer, or resell the Platform.

11. PAYMENTS & SUBSCRIPTIONS

  1. Some features may require payment or subscription.

  2. Payments may be processed through approved third-party gateways.

  3. Fees are non-refundable unless expressly stated.

  4. Pricing and plans may change with notice.

12. THIRD-PARTY SERVICES

The Platform relies on third-party services including:

  • Google Maps

  • Cloud hosting providers

  • Payment gateways

  • Mobile app stores

Jaylan Solutions is not responsible for outages or failures caused by third parties.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  1. Jaylan Solutions shall not be liable for:

    • Indirect or consequential damages

    • Data inaccuracies provided by users

    • Misuse of the Platform by schools, parents, or drivers

  2. The Platform is provided “as is” without warranties of uninterrupted operation.

14. SUSPENSION & TERMINATION

Jaylan Solutions may suspend or terminate access:

  • For violation of these Terms

  • For misuse involving child data

  • For security or legal compliance reasons

Upon termination, access to the Platform will cease.

15. MODIFICATIONS

  1. Jaylan Solutions may update these Terms from time to time.

  2. Continued use of the Platform constitutes acceptance of updated Terms.

16. GOVERNING LAW

These Terms are governed by the laws of the Republic of Kenya.
